About the Group

The Intellectual Property Working Group was established in 2006 and represents various companies and stakeholders to European state members. The Working Group is focusing on crucial issues of intellectual property (IP) protection and enforcement, such as bad faith registration of well-known trademarks, border control, copyright, and patent registration. 

In addition to IP issues the Working Group is also monitoring the regulatory framework pertaining to information technology, such as data protection, e-commerce, information security management, among other things. The Working Group runs ad hoc-based meetings on top of periodical communications for general updates and development regarding IP and information technology matters.

In 2017 the Working Group mainly advocated on the Patent Law, in particular concerning Article 20, which requires patent holders to manufacture products in Indonesia. The Working Group briefed EuroCham Indonesia members in regard to the Patent Law including on possibility of implementing regulation on Article 20 of the Patent Law, that mandates all patent holders to produce their goods in Indonesia.

The working group was also involved in the joint recommendation for EI-CEPA (EU-Indonesia Comprehensive Economic Partnership Agreement) with KADIN and Apindo. Letters of recommendation for both draft bills were sent to the government to channel the concerns and suggestions from European businesses. Furthermore, the Working Group conducted a briefing with the National Police regarding IP Enforcement. This event elaborated on how the authorities handle cases of IP infringement, mostly in the form of counterfeited products as well as illegal products.

The Working Group is currently monitoring and working on a few of ongoing advocacy efforts, covering:

  • Enforcement of Intellectual Property in Indonesia. 
  • Patent Law. 
  • Protection of well-known marks under the Trade Mark Law. 
  • Electronic Information and Transaction Law and data protection.
