Published on 6 May 2022

On 5 April 2022, EuroCham had the opportunity to meet with Oke Nurwan, the Director General of Domestic Trade of the Indonesian Ministry of Trade, to discuss the implementation of the Minister of Trade Regulation No. 50 of 2020, mainly related to the requirements for registration of online trade business actors. The Ministry of Trade Regulation No. 50 of 2020 is very important for e-commerce business activities considering that it regulates trade licensing for trade actor in electronic system to ensure that the consumers’ rights are protected. This regulation is aligned also with the obligation that is mandated by Article 65 of Law No. 7 of 2014 on Trade Affairs that requires online merchants to provide data and information to the public completely and correctly. This requirement helps ensure that consumers acquire reliable information related to the merchant and goods sold electronically.

However, during this meeting the Ministry of Trade mentioned that there are some exemptions to the licensing requirements as stipulated by the Minister of Trade Regulation No. 50 of 2020 for informal businesses. During the meeting, EuroCham conveyed its appreciation to the Ministry of Trade that have tried to create transparency related to the registration of licenses for online merchants. However, further clarification is required in future relating to the interpretation that there is a distinction between requirements for formal and informal business forms. This meeting was attended by representatives from various EuroCham Working Groups, with Evi Tiana of Rouse Consulting as the appointed spokesperson from the Intellectual Property Working Group.
